Making original work is hard. If someone posted yours on kre8 without permission, here is how to tell us, and how an uploader can answer.
Our policy
Under our Terms of Service and Content Policy, you may only post, upload, stream or sell work on kre8 that you own or have the right to share, within the limits of fair use (opens in a new tab). kre8 is run by Gully Labs LLC ("we", "us"). We respond to notices of claimed infringement under the US Digital Millennium Copyright Act (17 U.S.C. § 512).
Notice of claimed infringement
If you own the copyright in a work (or may act for the owner) and believe it is used on kre8 without permission, send us a written notice that includes:
- A physical or electronic signature of a person authorised to act for the owner of the exclusive right that is allegedly infringed.
- Identification of the copyrighted work claimed to be infringed, or, if there are several, a representative list.
- Identification of the material you believe is infringing, with enough detail for us to find it: the kre8 link (URL) of each post, track, artwork, video, Short, stream or profile.
- Your name and contact details: an email address is best; a phone number or postal address also works.
- A statement that you believe in good faith that the use is not authorised by the copyright owner, its agent or the law.
- A statement that the information in the notice is accurate and, under penalty of perjury, that you are authorised to act for the owner of the exclusive right that is allegedly infringed.
Where to send notices
- For tracks and artwork: use the copyright notice form on the creator terms page. It asks for every item above.
- For videos, Shorts and live streams: use Report on the player and choose Copyright, then email the notice to the address below.
- By email, for anything on kre8: [email protected]. You can also reach us at [email protected].
Our designated agent for copyright notices is Gully Labs LLC, Oregon, USA, at [email protected].
What happens next
When we receive a valid notice, we remove or disable access to the material quickly; removed tracks and videos show as unavailable. We tell the uploader, with a copy of the notice or its substance, so they can respond. We may share the notice, including your name and contact details, with the uploader and keep a record of it.
An incomplete notice may delay our response; we will tell you what is missing where we can.
Counter-notice
If your material was removed and you believe that was a mistake or a misidentification, you can send a written counter-notice to [email protected] that includes:
- Your physical or electronic signature.
- Identification of the material that was removed and where it appeared on kre8 before it was removed (the link).
- A statement under penalty of perjury that you believe in good faith the material was removed or disabled as a result of a mistake or misidentification.
- Your name, address and phone number.
- A statement that you consent to the jurisdiction of the US Federal District Court for the judicial district where your address is, or, if your address is outside the United States, the US District Court for the District of Oregon, and that you will accept service of process from the person who sent the original notice or their agent.
We send the counter-notice to the person who sent the original notice. Unless they tell us within 10 to 14 business days that they have filed a court action to stop the infringement, we may restore the material.
False claims
Under 17 U.S.C. § 512(f), anyone who knowingly makes a material misrepresentation in a notice or counter-notice may be liable for damages. Please be sure before you send one; if you are not sure whether something infringes, consider getting legal advice first.
Repeat infringers
We terminate, in appropriate circumstances, the accounts of people who repeatedly infringe copyright. Repeat infringers lose upload access and may lose their account. We may also remove material without a notice if it is clearly infringing.
On chain and on IPFS
Coins, editions, .gully names and transactions are recorded on Gully Chain, a public blockchain, and some media is stored on IPFS. We can remove material from kre8 and stop serving and pinning it from our servers, but we cannot change or delete what is written on chain, and copies on other IPFS nodes may remain.
Trademarks and other rights
For trademark, privacy or other complaints that are not about copyright, email [email protected] with the link and what is wrong, or see the Content Policy.
